CONDENSED TOS
NOTICE: This is the CONDENSED version of the TOS.Detailed info may be missing. The sole purpose of this condensed version is for the Customer to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms, which WILL apply to your orders. In the event of any conflict, the full Terms of Service shall govern. The shortened version is provided for convenience only and is non-binding!
Pay up front for orders. Payment plans may be discussed for payments over $150.
Product will be delivered digitally via Toyhouse and or Email.
Seller will not be responsible for loss of product once it has been delivered.
Customer may request revisions. If the revisions are requested LATE into the process, they may be charged for the additional work.
Customer has the right to reasonable amounts of minor edits after completion (I.E, eyecolor change).
Must be paid in USD.
Customer can ask for a refund on orders with no STARTING progress for 3 weeks, no progressive work for 4 months, or when work has not been completed within 7 months. OTHERWISE, I do NOT do refunds; payments are final.
Customer is required to contact the seller in a fast and responsive manner; otherwise, work may be delayed. Silence (3 days or more) may be seen as approval.
Products cannot be used for commercial purposes without additional fees; this can be discussed.
I can cancel and refund any order at any time due to external circumstances.
Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space. NO AI USAGE.
Customer does not hold the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space.
TERMS OF SERVICE
LAST UPDATE: 06/13/2025This contract applies to the artist further called Seller and person or institution further called Customer purchasing from Seller a work of art further called Product. By ordering Product from the Seller the Customer agrees to the following terms and conditions:PAYMENTS
1. Customer agrees to pay the due amount upfront for any orders of value lower or equal to $150.
2. On orders above $150 customer has the option to pay half the invoice total upfront. The other half may be paid on approval of the initial sketch, or additional payment plans can be discussed.
3. Any other payment schedule has to be mutually agreed upon before work on the Product commences.
4. Customer accepts that work on the Product will not commence until payment has been received by Seller according to the above schedule.
5. Certain types of work do not allow for a split payment. In such cases customer will be informed about this and will be asked to agree on a different payment schedule, before any work can commence.PRODUCT DELIVERY
6. Customer agrees that Product will be delivered digitally to the email and or Toyhouse address provided by Customer, after the final/full payment has been received by the Seller.
7. Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Customer is obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.
8. It is sole responsibility of Customer to propose a delivery method that works for both parties. Seller cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters, or any other technical obstacles outside responsibility of the Seller.
8b. Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer loses their files.REVISIONS
9. Customer has the right to request revisions in the sketching phase free of charge.
10. Customer has right to a reasonable amount of minor edits after completion, such as changing an eye color or fixing a small detail, up to an additional 10% of the total time spent on creating the originally delivered Product. Any requests above that, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received. Time spent is measured at Seller’s sole discretion.CURRENCY CONVERSIONS
11. Customer agrees to pay the total amount specified in USD.
12. It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller.
13. Payment is considered as received and completed only when the total amount received on the Seller's USD account is equal to the invoice amount in USD.REFUND POLICY
14. Customer has the right to request a full refund if there has been no additional progress for 4 consecutive months, no starting progress within 3 weeks, or when Product has not been completed within 7 months. Refund conditions for commissions that require more work must be agreed separately, before the work commences. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident, or any other credibly documented reason for interruption of work. Implicit approval under Section 15 constitutes valid progress for purposes of the refund policy.
15. Customer is obliged to contact the Seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication (3 days wait) on behalf of Customer will be recognized as implicit approval of all work progress and the current state of the Product.PERSONAL AND COMMERCIAL USE
16. The Product received by the Customer is for personal use. Any use of the Product for commercial purposes, reselling it, reproduction, or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product.Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.CANCELLATIONS
17. Seller reserves every right to refuse or cancel any order, under the condition of full or partial refund, without giving reasons to the Customer. Seller’s cancellation rights under Section 17 operate independently of the refund conditions outlined in Section 14.
18. Any disrespectful behavior will not be tolerated and may result in a cancellation of the order. Customer will receive a full or partial refund depending on the amount of work completed. Seller will have the full right to refuse any service to the Customer in the future.This TOS was used from this example, please feel free to adjust it to your own desire.

◦ Mecha (limited to simplistic to slightly complex, though I will deny very complex designs)
◦ Characters with non-typical anthropomorphic qualities (such as a more animalistic hunched-over posture or varying physique)
◦ NSFW (ID age verification required, certain information may be censored at the client’s discretion)
I WON'T DRAW/DO
◦ Certain NSFW themes (I will not draw animal accurate or resembling genitalia, anything relating to harmful fetishes that glorify real trauma, no animal feral NSFW, or humans, as I am still learning to stylize them)
◦ Complex mecha
◦ Anything relating to conservative political messaging, anything promoting hate speech, or promoting homophobia, racism, etc.
◦ Complex or very detailed backgrounds
◦ Replicate another artist's style
◦ Replicate a preexisting character design (I can inspire certain elements from the character, but I will not create a look-alike)
◦ IMPORTANT NOTE: For NSFW references, the Customer MAY NOT send videos or images of themselves! Images must be drawn or created from a real nude model; no AI-generated images. All images must be sent with a proper warning in advance!

Condensed Design TOS

The shortened version is provided for convenience!
Customer, upon purchasing the design, has the right to alter it to the extent they wish. However, the Customer may NOT edit, draw over, or otherwise alter the original art done by the Seller. If the Customer wishes to do so, the Customer must inquire with the Seller first. Seller retains the right to decline, and the Customer is obligated to respect the decision. Furthermore, Customer may not sell the redesign separate from the original.
Customer may resell the design for the original purchased amount and any additional commissioned art or personal art (given it is appropriately valued by the owner). If the design has no original monetary value, it may be vouchered for an amount both parties deem appropriate or sold for the exact amount of commissioned artwork, if any.
Customer may NOT sell designs for more than their monetary value; doing so will result in a blacklist.
Customer may not use the design for commercial purposes unless agreed upon with the Seller beforehand.
Customer may "hide" the character's profile on Toyhouse, and does not need to inquire about permission to do so.
Customer is not allowed to turn a one-off design into a closed species, especially with intentions to profit from it.
Customer is not permitted to delete the existing character from Toyhouse without explicit permission from the Seller.
Customer may not remove the Sellers watermark.
Customer may co-own the design with another party. However, any disputes will not be brought to the Seller, and must be handled solely by included individuals.
